What is a sworn translation?

A sworn translation or official translation is a translation signed and stamped by a sworn translator. According to Spanish legislation it’s mandatory for all documents written in a foreign language and that have to take legal effect in Spain are accompanied by the corresponding sworn translation or official translation.

Nowadays, the construct of a sworn translator is essential in our society due to the current situation in which the internationalisation of businesses and the free market consequently have a great demand for sworn translations.

The sworn translator has been enabled by the Foreign Office by means of stamp and signature to accredit the veracity of a foreign document. All of the translations carried out by sworn translators have an official capacity before the authorities and public bodies.

When is a sworn translation and a sworn translator needed?

A sworn translation or official translation is required for those documents written in another language that must take legal effect before an official body. An official translation is always signed and stamped by a sworn translator and has official capacity before the authorities.

Legalisation of documents

The legalisation of foreign documents is essential so that they take effect in Spain. Consequently, unless an agreement, treaty or international agreement exists that provides exemption from authentication, the same thing will be done in accordance with one of the following two procedures depending on the country that issues the document:

  • If the country is a signatory of the Hague Apostille, the Apostille will be sufficient.
  • If the country isn’t a signatory of the Hague Apostille, the route of legalisation will be different in each case
